ANTECEDENTES

I. El 10 de febrero de 2014, mediante Decreto publicado en el DOF, se reformó el artículo 41 de la CPEUM, el cual dispone en su Base V, apartado A, párrafos primero y segundo, que el INE es un organismo público autónomo, dotado de personalidad jurídica y patrimonio propios, en cuya integración participan el Poder Legislativo de la Unión, los partidos políticos y la ciudadanía; que es autoridad en la materia electoral, independiente en sus decisiones y funcionamiento, profesional en su desempeño, regido por los principios de certeza, legalidad, independencia, imparcialidad, máxima publicidad, objetividad, equidad y cuyas actuaciones son realizadas con perspectiva de género.

II. Así, en dicho artículo 41, Base V, apartado B, penúltimo párrafo, se establece que corresponde al CG del INE, la fiscalización de las finanzas de los partidos políticos.

III. El 23 de mayo de 2014, se publicó en el DOF el Decreto por el que se expidió la LGIPE, en cuyo libro cuarto, título segundo, capítulos cuarto y quinto, se establecen las facultades y atribuciones de la COF y de la UTF, respectivamente, así como las reglas para su desempeño y los límites precisos de su competencia.

IV. El 23 de mayo de 2014 se publicó en el DOF el Decreto por el que se expide la LGPP, en la que se establece, entre otras cuestiones: I) La distribución de competencias en materia de partidos políticos; II) Los derechos y obligaciones de los partidos políticos; III) El financiamiento de los partidos políticos; IV) El régimen financiero de los partidos políticos; y V) la fiscalización de los partidos políticos.

V. El 19 de noviembre de 2014, en sesión extraordinaria del CG del INE se aprobó el Acuerdo INE/CG263/2014, por el cual se expidió el RF y se abrogó el RF aprobado el 4 de julio de 2011, por el CG del entonces Instituto Federal Electoral, mediante el Acuerdo CG201/2011, el cual ha sido modificado mediante los acuerdos INE/CG350/2014, INE/CG1047/2015, INE/CG320/2016, INE/CG875/2016, INE/CG68/2017, INE/CG409/2017, INE/CG04/2018, INE/CG174/2020 e INE/CG522/2023.

VI. El 5 de septiembre de 2024, mediante el Acuerdo INE/CG2211/2024, el CG del INE aprobó por unanimidad la integración de las presidencias de nueve comisiones permanentes y otros órganos; en consecuencia, la COF está presidida por la Consejera Electoral Carla Astrid Humphrey Jordan e integrada por la Consejera Electoral Dania Paola Ravel Cuevas, así como por los Consejeros Electorales Jorge Montaño Ventura, Jaime Rivera Velázquez y Uuc-kib Espadas Ancona; asimismo, cuenta con una Secretaría Técnica encabezada por la persona titular de la UTF.

VII. Que el 11 de diciembre de 2024, el Consejo de la Judicatura Federal publicó en el DOF, la lista de personas que pueden fungir como peritas o peritos ante los órganos del Poder Judicial de la Federación, correspondiente al año 2025, de conformidad con el artículo 86, fracción XXIX de la Ley Orgánica del PJF, así como el numeral 7 del Acuerdo General del Pleno del Consejo de la Judicatura Federal, que regula la integración de la lista de personas que pueden emitir peritajes ante los órganos del PJF.

VIII. El 10 de febrero de 2025, en su Segunda Sesión Extraordinaria la COF, aprobó por votación unánime de los presentes, el presente acuerdo.

CONSIDERANDOS

1. Que los artículos 41, Base II, segundo párrafo y Base V, Apartado A, párrafos primero y segundo de la CPEUM; y 29 y 30, numeral 2 de la LGIPE, establecen que el INE es un organismo público autónomo, dotado de personalidad jurídica y patrimonio, autoridad en materia electoral, independiente en sus decisiones y funcionamiento, cuyas actuaciones se rigen por los principios de certeza, legalidad, independencia, imparcialidad, máxima publicidad, objetividad, paridad y, se realizarán, con perspectiva de género.

2. Que de conformidad con los artículos 5 y 6 de la LGIPE, corresponde al INE, entre otras autoridades, la aplicación e interpretación de la normativa electoral, así como, en el ámbito de sus atribuciones, disponer lo necesario para asegurar el cumplimiento de las normas en materia electoral.

3. Que el artículo 30, numeral 1, incisos a), b), d), f) y g) de la LGIPE, establece que son fines del INE, contribuir al desarrollo de la vida democrática, preservar el fortalecimiento del régimen de partidos políticos, asegurar a la ciudadanía el ejercicio de sus derechos político-electorales y vigilar el cumplimiento de sus obligaciones; velar por la autenticidad y efectividad del sufragio; llevar a cabo la promoción del voto y coadyuvar a la difusión de la educación cívica y la cultura democrática.

4. Que de conformidad con el artículo 35 de la LGIPE, el CG es el órgano superior de dirección, responsable de vigilar el cumplimiento de las disposiciones constitucionales y legales en materia electoral, así como de velar porque los principios de certeza, legalidad, independencia, imparcialidad, máxima publicidad y objetividad guíen todas las actividades del INE.

5. Que el artículo 42, numerales 2 y 6, de la LGIPE, prevé la creación de la COF, la cual funcionará permanentemente y se integrará exclusivamente por consejeras y consejeros electorales designados por el CG, y contará con una secretaría técnica que será la persona titular de la UTF.

6. Que de conformidad con el artículo 44, numeral 1, inciso jj), de la LGIPE, el CG dictará los acuerdos necesarios para hacer efectivas sus atribuciones señaladas en la ley.

7. Que de acuerdo con el artículo 190, numerales 1 y 2, de la LGIPE, la fiscalización se realizará en los términos y conforme a los procedimientos previstos por la propia ley; además, la fiscalización de las finanzas estará a cargo del CG del INE por conducto de la COF.

8. Que el artículo 191, numeral 1, inciso a) de la LGIPE, establece que, el CG tendrá la facultad de emitir los lineamientos específicos en materia de fiscalización, contabilidad y registro de operaciones de los partidos políticos.

9. Que el artículo 192, numeral 1, incisos a) y d), de la LGIPE, señala que el CG del INE ejercerá las facultades de supervisión, seguimiento y control técnico y, en general, todos aquellos actos preparatorios a través de la COF, quien emitirá los acuerdos generales y normas técnicas que se requieran para regular el registro contable de los partidos políticos y revisará las funciones y acciones realizadas por la UTF, con la finalidad de garantizar la legalidad y certeza en los procesos de fiscalización.

10. Que el numeral 2, del artículo 192, de la LGIPE establece que, para el cumplimiento de sus funciones, la COF contará con la UTF.

11. Que el artículo 26, numeral 3, del RF señala que la comisión dará a conocer la Lista Nacional de personas autorizadas para realizar peritajes contables que será publicada en el DOF dentro de los 30 días posteriores al inicio del ejercicio.

12. Que el artículo 26, numeral 4, del RF señala que podrán ser personas autorizadas para emitir peritajes contables, las y los profesionistas registrados ante el PJF o ante el de cada entidad.

13. Que el 11 de diciembre de 2024, se publicó en el DOF la lista de personas que pueden fungir como peritas o peritos ante los órganos del Poder Judicial de la Federación, correspondiente al año 2025, entre otros, en materia de contabilidad.

14. Que al ser designadas deberán contar con registro vigente ante el PJF o ante el Poder Judicial de cada entidad federativa.

15. Que las listas de personas para emitir peritajes contables ante el PJF y de los estados se modifican y actualizan periódicamente, en algunos casos año con año, por lo que se considera necesario establecer la obligación para los sujetos obligados de verificar la vigencia del registro de las personas autorizadas para emitir peritajes contables al momento en que soliciten sus servicios, ya que la lista que deberá emplearse para efectos del RF será la vigente en sus respectivos ámbitos de competencia.

En virtud de lo anterior y con fundamento en lo previsto en los artículos 41, Base II, segundo párrafo, Base V, apartado A, párrafos primero y segundo de la CPEUM; 5, 6, 29, 30, numeral 1, incisos a), b), d), f) y g), numeral 2, 35, 42, numerales 2 y 6, 44, numeral 1, inciso jj), 190, numerales 1 y 2, 191 numeral 1, inciso a), 192, numeral 1, incisos a) y d), numeral 2, de la LGIPE; 26, numerales 3 y 4, del RF, se ha determinado emitir el siguiente:

Las modificaciones o actualizaciones que los Poderes Judiciales, tanto Federal como de las entidades federativas que correspondan, realicen a sus registros de personas autorizadas para emitir peritajes contables, tendrán efectos vinculantes con el presente Acuerdo, por lo que las personas y sujetos obligados deberán verificar la vigencia del registro, al momento en que soliciten sus servicios.

CUARTO. El presente acuerdo entrará en vigor a partir del día siguiente de su aprobación por el Consejo General del Instituto Nacional Electoral.

QUINTO. Se instruye a la Unidad Técnica de Fiscalización para que notifique el presente Acuerdo a los partidos políticos nacionales y locales, a través del módulo de notificaciones electrónicas del Sistema Integral de Fiscalización.

SEXTO. Publíquese el presente Acuerdo en el Diario Oficial de la Federación, así como en la página de Internet del Instituto Nacional Electoral.
